Remaining arguments heard. The complainant has filed the present complaint under the Consumer Protection Act for restraining the opposite parties from claiming interest or Rs.8,41,670/- and service tax of Rs.38625/- besides demanding any penal charges or interest in future. The present complainant had earlier filed a complaint which was decided by this Forum vide order dated 25.11.2014. While deciding that complaint it was observed by this Forum that opposite parties are also at fault, as such it shall not be entitled to demand interest or penal interest from the complainant. However, opposite parties were held entitled to external development charges. Against the above said order, the complainant has filed appeal which is pending before Hon'ble State Commission. While admitting the appeal, the Hon'ble State Commission has stayed the demand of external development charges by the developer. Further while passing the above said stay order, the Hon'ble State Commission has also noted that it was further submitted that inspite of findings of District Forum that opposite parties No.1 to 4 are at fault and were held not to entitle to demand of interest or penal interest from the complainant in this regard, no order was passed by District Forum. So matter regarding interest is also pending before Hon'ble State Commission in the above said appeal. In the present complaint, the dispute is also regarding the amount of interest demanded by the opposite parties and service tax. So in the above circumstances, we feel it expedient to stay the present complaint till the decision of appeal by Hon'ble State Commission. File be consigned to the record room for the time being. After the decision of the appeal by Hon'ble State Commission either party shall be at liberty to get the present proceedings revived.
