             Ms. Shabina Ali, learned counsel for the respondent no.1.

             None for the respondent no.2 though served.

 

As per Shri Justice Shantanu S. Kemkar :                       

                        Heard learned counsel for the petitioner and learned counsel for respondent no.1.

2.                     This revision is directed against the order dated 02.04.2016 passed by the District Consumer Disputes Redressal Forum, Jabalpur (For short the ‘Forum’) in C.C.No.573/2015, whereby the Forum has proceeded ex-parte against the petitioner/opposite party no.2 presuming service of notice on him as acknowledgement did not receive even after lapse of 30 days.

3.                     Having gone through the proceedings dated 02.04.2016 and the record of the Forum and having considered the submissions made by learned counsel for parties, we are satisfied that notice was not served on petitioner/opposite party no.2 before the Forum and as such the petitioner/opposite party no.2 could not appear and file reply in the Forum.

4.                     In the circumstances, we set-aside the impugned order and permit the petitioner to file reply within 30 days from the date of appearance. Parties to appear before the Forum on 05.08.2019.  The District Forum shall thereafter proceed in the matter in accordance with law.

5.                     In the result, the revision petition stands allowed.
