Today, none has appeared on behalf of the appellant inspite of several calls.

A registered court notice dated 21.03.2024 was issued to the appellant for moving the substitution application for impleading the legal heirs of Sh. Amarjeet Singh, Proprietor of the appellant, which was received back in the office with the postal endorsement that the recipient has refused to accept the notice.

From the perusal of the record, it is apparent that the information regarding death of Sh. Amarjeet Singh, Proprietor of the appellant, was given by Sh. Deepak Ahluwalia, learned counsel for the appellant, on 15.03.2024.

The statutory period of 90 days’ prescribed for moving the substitution application has already expired, but no steps have been taken by the appellant for substituting the legal heirs of deceased Proprietor of the appellant.

In such circumstances, the appeal stands abated.  No order as to costs.

File be consigned to the record room along with copy of this order.

A copy of this order be sent to the concerned District Commission for perusal, information and necessary action.
