ORDER  IN  THE  QUESTION  OF  MAINTAINABILITY

  1. Complainant states that he is a vendor of home interior accessories. Enamored by the representation held out by opposite party, the complainant purchased goods from opposite party and sold it to his customers. Contrary to the representations made out by  opposite party, the goods sold by him was of inferior quality, damaging complainant’s goodwill and revenue.  Aggrieved thereby, this complaint is filed.
  2. Even though the opposite party had filed version, this Commission need not refer to the contents therein to come to a conclusion that the complainant purchased merchandise from the opposite party for resale and for generation of profit. Resultantly, this Commission is devoid of jurisdiction to adjudicate the dispute, notwithstanding the merits or demerits of the case.
  3. Accordingly, complaint stands dismissed.
