O R D E R

NAWAB SINGH J, (ORAL)

 

          Nirmla Devi-complainant filed complaint under Section 12 of the Consumer Protection Act, 1986 before District Consumer Disputes Redressal Forum, Rewari (for short ‘District Forum’), whereby complaint was allowed.

2.      Aggrieved of the said order, Dr. Sharda Dabas-opposite party No.4 filed appeal before this Commission, the appeal was accepted and the complaint was dismissed.

3.      Against the said order, Nirmla Devi-complainant filed revision petition before Hon’ble National Consumer Disputes Redressal Commission, New Delhi. The Hon’ble National Commission remanded the case to this Commission to decide it afresh by order dated 05th December, 2014. The parties were directed to appear before this Commission on 15th January, 2015. 4.  On 17th March, 2015 Shri R.K. Saini, proxy counsel for Mr. Pankaj Chugh, Advocate appeared on behalf of the appellant-Dr. Sharda Dabas. On 05th May, 2015, 14th July, 2015, 07th August, 2015, 09th October, 2015, 03rd December, 2015, 27th January, 2016, 21st March, 2016, 11th May, 2016, 15th July, 2016, 26th September, 2016 and 31st October, 2016 nobody appeared on behalf of Dr. Sharda Dabas. Today also, position is the same. It appears that the appellant is not interested in pursuing the appeal. The appeal is dismissed in default.
