The Appeal has been called out the second time. Still, no one appears for the Appellant. Mr. Rajbir Singh Guron appears on behalf of the Respondent/Complainant and says that he will file his vakalatnama during the course of the day. Let him do so. Vide order dated 13.04.2017, while issuing notice in the Appeal, we had granted an ad-interim stay of certain directions issued by the State Commission in the order impugned in the Appeal, subject to the Appellant’s making payment to the Complainant by way of interest @ 9% p.a., on the total amount deposited by her with it, for the period commencing from the committed date of delivery, viz. 02.04.2014, within eight weeks from the date of the said order. While directing payment of the said amount by means of a bank draft/banker’s cheque, it was also clarified that in the event of non-compliance with the order, the interim stay shall stand vacated forthwith and it will be open to the Complainant to pursue her remedy, as may be available to her in law. It is pointed out by learned Counsel appearing for the Complainant that the Appellant has not made any payment to the Complainant, in terms of the said order. In view of the above, while dismissing the Appeal for non-prosecution, we clarify that there is no stay of the order impugned in this Appeal and it will be open to the Complainant to have the same enforced in accordance with law. |
