FINAL ORDER

The instant complaint has been filed by the complainant u/s 12 of C.P. Act, 1986  praying for direction upon the OP to refund a sum Rs.90000/- along with interest of Rs.9000/-.

The complaint, in brief, is that the complainant decided to a purchase a flat from OPs and as per Agreement the complainant paid Rs.100000/- as advance on 11.01.14. But due to financial problem the complainant was unable to pay the balance amount and requested the OPs to return back the advance amount. The complainant also sent a letter to the OPs on 10.03.15 but the OPs were reluctant to refund the sum to the complainant and as such the complainant is compelled to file this case. Hence, the instant complaint.

The complainant and the OPs appeared before the Forum by fling Solenama and submit that the dispute has been settled between the parties. As per Solenama, the OPs paid Rs.78000/- to the complainant and the agreement dated 11.01.14 has been cancelled. They also submitted that henceforth they will have no claim against each other.

Considering the submission of both the parties, we are of the view that the case be disposed of being withdrawn. The Solenama be made a part of the order.

 Hence,

ORDERED

that the consumer complaint No. CC/64/2015 be and the same is disposed of being withdrawn.

            The Solenama do made part of the order.

 Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post  to the concerned parties as per rules, for information and necessary action.
