This complaint is filed by the Complainant u/S 35 of the Consumer Protection Act, 2019.

Today is fixed for admission hearing of this complaint. The Complainant is present in person. During admission hearing it is noticed by us that the Complainant has made the manufacturer as a party in this complaint, but the dealer from where the goods was purchased, the same has not been a party in this proceedings. Under the amended Consumer protection Act, 2019 the product seller should be made necessary party in the petition of compliant. Due to this reason we are not in a position to admit the complaint for such defect.

Going by the foregoing discussion hence, it is ordered that the Consumer Complaint being no- CC/122/2021 is hereby dismissed without being admitted. There is no order as to cost. However the Complainant is at liberty to approach before the competent Court/Commission for redressal of his/her grievance, if not barred otherwise in a proper manner after removing the aforementioned defect.

As the complaint is not admitted hence the Complainant is at liberty to get return of the copy of the complaint along with the copies of the documents as filed by her at the time of filing this complaint. But for this purpose the Complainant has to submit an application before the appropriate authority of this Ld. Commission. The appropriate authority is directed to take immediate step upon receipt of the application from the Complainant so that the Complainant can get return of the aforementioned photocopies without any further delay.

Let plain copy of this order be given to the parties free of cost as per the CPR.
