Today the case was fixed for evidence of OPs. However, parties entered into compromise. Learned counsel for the OPs Sh. Sumit Gupta Advocate offered an amount of Rs. 12,000/- after deducting the depreciation amount from the billed amount subject to deposit of old hand set with all accessories (without broken and water logged). On the other hand, learned counsel for the complainant accepted the offer made by the OPs. Statement of both the parties in this regard recorded separately.
In view of the statement of both the parties, the present complaint is hereby partly allowed as per compromise. OPs are accordingly directed to make the payment of Rs. 12,000/- to the complainant subject to deposit of old mobile set alongwith accessories within a period of 30 days failing which the complainant shall be entitled to recover the interest at the rate of 7% per annum for the defaulting period. Both the parties shall be bound by their statements recorded separately. Copies of this order be sent to the parties concerned free of costs as per rules. File be consigned to the record room after due compliance.
