Hawa Singh vs. New India Assurance Co. Ltd.

Present:       Sh. Shanti Lal, Advocate for complainant.                         

                  Sh. Kapil Sharma, Advocate for op no.1.

                   File put up today on the application moved on behalf of op no.1 to record the compromise of the parties. Learned counsel for op no.1 has suffered a statement that a compromise has been arrived at between complainant and op no.1 and op no.1 is ready to pay Rs.77,500/- in full and final settlement to the complainant i.e. Rs.70,000/- being IDV of the buffalo and remaining amount of Rs.7500/- being interest, compensation and litigation expenses etc. to the complainant within 45 days and present complaint may be disposed of accordingly in the Lok Adalat as per compromise.

                  Learned counsel for complainant has also suffered a statement that he is satisfied with the above statement of learned counsel for op no.1 and present complaint may be disposed of accordingly as per compromise in the Lok Adalat. In view of the statements of learned counsel for op no.1 and learned counsel for complainant as op no.1 is ready to pay the amount of Rs.77,500/- being IDV value of buffalo alongwith interest, compensation and litigation expenses and complainant is ready to receive the said amount , the present complaint stands disposed of accordingly and op no.1 shall pay above said amount of Rs.77,500/- to the complainant within 45 days from today as per compromise and op no.1 shall be bound down in this regard by statement of learned counsel for op no.1. A copy of this order be supplied to the parties as per rules. File be consigned to the record room.
