We do not find any ground to transfer the Complaint bearing No.276/2011, pending before the District Forum, Gautam Budh Nagar, to this Commission.  However, having regard to the fact that the final arguments in the Complaint, are stated to have been heard as far back as in the year 2014, we direct the District Forum to take a final decision in the Complaint as expeditiously as possible and in any case not later than two months from the date of receipt of a copy of this order. 

We also request the Learned President of the U.P. State Consumer Disputes Redressal Commission to obtain a report from the concerned District Forum as to why the final orders in the Complaint have not so far been passed, in a case where the Opposite Party had been proceeded against ex parte and final arguments in the Complaint, on behalf of the Complainant were heard some time in the year 2014.  On receipt of the report, the learned President may issue appropriate directions, as he may deem fit, so that such delays are avoided.

        A copy of this order shall be forwarded by the office to the President, State Commission, U.P. forthwith.

        In the final result, the Transfer Application is dismissed with the afore-noted directions.

        The Complainant, a senior citizen, who appears in person, is not aware of the next date of hearing, let him appear before the concerned District Forum on 6.3.2018 along with a copy of this order for further proceedings.
