The applicant as well as her counsel are absent. Respondents are also absent.. No proof of service of notice to the Respondent is filed by the applicant. Record reflects that the applicant and her counsel are absent since long. Therefore the appeal deserves to be dismissed in default.

Moreover, on perusal of MA No.238/10 i.e. application for condonation of delay, it reflects that there is inordinate delay of 320 days in filing appeal but except the contention of the appellant that she was ailing, there is no supporting documents. Thus, there is no just and reasonable ground to condone the delay. Hence the application for condonation of delay as well as the appeal are dismissed in default.
