1. New Mobile Point, Vasant Vihar, Karnal through its prop/partner.

2. Lava International Pvt. Ltd., A-56, Sector-64, Noida-201301 (U.P.) through its Managing Director.

3. Lava Service Center, c/o M/s Sai Kirpa Care Centre, SCO 110, 1^st floor, mugal Canal, Karnal, through its prop.

                     Complaint u/s 12  of the Consumer Protection Act.

ORDER:

                   The Learned counsel for the opposite parties no.2 and 3 made statement that the opposite parties are ready to make payment of Rs.3500/- after deducting the depreciated amount of the original cost of the mobile, subject to the condition that the complainant shall return the old mobile set alongwith all the accessories to the opposite parties, provided the same is not in broken condition or having liquid damage and demanded 30 days time.      

                   Thereafter, learned counsel for the complainant made statement for withdrawal of the complaint by submitting that having regard to the statement of the learned counsel for the opposite parties, he does not want to pursue with the present complaint. Statements of both the parties recorded separately.

                   In view of that the present complaint is dismissed as withdrawn. However, both the parties shall be bound by their respective statements. The parties concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
