Appellant as well as his counsel Shri.Sawang are absent. Adv.Ramteke for the Respondent is present. Record reflects that appellant and his counsel are absent since May,2010 though the Respondent's counsel is appearing regularly on each date. On perusal of the record, it further reflects that there is inordinate delay of 7 months and 25 days in filing this appeal and the appellant has filed separate application for condonation of delay, but this application does not reflect any just and reasonable ground to condone such inordinate delay. Hence the application for condonation delay stands rejected. Consequently the appeal also stands rejected as barred by limitation and also in default. No order as to costs.
