          Sh.P.N.Khanna, Advocate counsel for Opposite Parties No.1 and 2 has suffered a statement that as per the decision of the company in order to dispose of the matter in the present complaint, if the complainant gets the vehicle in question dismantled in the presence of the surveyor of the company, the loss will be considered on the repair basis if it is less than 75%. In case, the loss is considered by the surveyor exceeding 75% of the sum assured, the claim will be considered on total loss basis. It is however, added that deterioration of the value of the vehicle due to environmental factors and stolen parts will not be considered.  At this stage, Sh.Deepinder Singh, Advocate counsel for the complainant also suffered statement that in view of the above statement, the Forum may pass appropriate order  in the present case.

           Since the parties have compromised the matter, the complainant is directed to get the vehicle in question dismantled in the presence of the surveyor of the company and the loss will be considered on the repair basis if it is less than 75%. In case the loss is considered by the surveyor exceeding 75% of the sum assured, the claim will be considered on total loss basis. It is however, added that deterioration of the value of the vehicle due to environmental factors and stolen parts will not be considered. Opposite Parties No.1 and 2 are directed to dispose of the claim of the complainant as per the surveyor report; the terms and conditions of the policy and IRDA guidelines. Opposite Parties No.1 and 2 are further directed to dispose of the claim of the complainant as per above guidelines, within 30 days from the date of receipt of copy of the order.  Copies of the order be furnished to the parties free of costs. File is ordered to be consigned to the record room.
