1. This complaint is filed under section 12 of Consumer Protection Act 1986 and stood over to this date for consideration and this Commission passed the following order.
2. The complainant filed this complaint against the opposite party alleging deficiency in service on the part of the opposite party in connection with the repudiation of the insurance claim made by the complainant by the opposite party. After admitting the complaint notice was issued to the opposite party. Though the opposite party accepted the notice, failed to appear before this Commission on the date fixed for the appearance of the opposite party and hence on 21.11.2019 the opposite party was declared exparte. Since 20.02.2020 this case was adjourned for the affidavit of the complainant. As the complainant was continuously absent, this Commission issued a notice to the complainant to appear before this Commission on 16.06.2022 to further proceed with this complaint. When the case came up for consideration on 16.06.2022 the complainant appeared before this Commission and submitted that Rs.4000/-has been deposited to his account by the opposite party. Hence the case was adjourned to 26.07.2022 for the affidavit of the complainant.
Meanwhile the complainant filed a memo before this Commission stating that as the complainant has received Rs.4000/- from the opposite party, he is not interested to further proceed with this complaint and sought permission to withdraw the complaint.
The case was suo moto advanced from 26.07.2022 to this date for considering the memo filed by the complainant. A memo filed by the complainant is accepted and recorded. In view of the memo filed by the complainant, we find that this is a fit case to be dismissed as not pressed.
In the result, the complaint is dismissed as not pressed. There will be no order as to costs.
A copy of this order as per the statutory requirements be forwarded to the parties free of charge and thereafter the file be consigned to the record room.
