Both sides are present. Heard both sides. In this case, fresh survey of the damaged vehicle was done and the surveyor reported that the net loss amount stands at Rs. 2,47,299/-. The Id. counsel for the claimant has made some objections, regarding the aforesaid amount and prayed for a bigger amount. The Id. counsel for the Insurance Company has submitted that the Insurance Company would have no objection, if the Forum directs it to pay a total amount of Rs. 2,50,000/-.

I have heard both sides in this matter. The Id. counsel for the claimant has still objected to this, but I find that this amount of Rs. 2,50,000/- would be just and adequate in the interest of justice. The Id. counsel for the claimant has ultimately accepted this contention and on the basis of the submission of both sides, the Insurance Company is directed to pay an amount of Rs. 2,50,000/- (Rupees Two Lakh Fifty Thousand Only) to the claimant within one month. The matter stands disposed of. The damaged vehicle would be given to the claimant. The case is accordingly disposed off.
