This Revision Petition has been directed against an interim order passed by the State Commission dated 16.3.2005.

Petitioner was the complainant before the District Forum.  District Forum had allowed the complaint and directed the opposite party to pay to the complainant, the insured amount of Rs.17 lakh along with interest at the rate of 12% per annum after six months from the date of incident till its payment.  Rs.10,000/- was awarded as compensation and Rs.5,000/- by way of expenses.

Against the order passed by the District Forum, opposite party had filed a statutory appeal.  While issuing Notice to the petitioner, the State Commission directed the respondent to deposit a sum of Rs.4,32,055/- in cash or by bank draft with the District Forum concerned within a month from the date of passing of the order and the execution proceedings for the rest of the amount were stayed.

Against the interim order passed by the State Commission, present Revision Petition has been filed.  Notice was issued to the respondent on 24.4.2009.  30 days from issuance of the Notice are over.  Respondent is deemed to have been served with the Notice.  Ordered to be proceeded ex parte.

We are not inclined to interfere with the interim order passed by the State Commission.  Dismissed.

However, the State Commission is requested to dispose of the Appeal if the same has already not been disposed of within 3 months of the receipt of this order.  Copy of this order be sent to the Registrar of the State Commission.
