Appellant as well as his counsel has not appeared before the Commission for placing their arguments after several calls, whereas learned counsel Sh. R.K. Garg for respondent has appeared.

Learned counsel for respondent has stated that the appellant is not appearing since a long time for contesting the case.

A perusal of the order sheet reveals that the appellant is not contesting his case since a long time which shows that the appellant is not interested to contest his appeal, hence in the absence of the appellant, the appeal shall stand as dismissed. No order as to costs.
