Referring to the finding of doctor recorded on 11.3.2003, last attendant the deceased assured and also the cause of death, learned counsel for the petitioner states that repudiation of claim of the insured was within road parameter of the policy issued by petitioner – Corporation.

Subject to petitioner directly remitting a sum of Rs.3000/- by means of demand draft within a period of four weeks to the respondent, issue notice to respondent returnable on 6.5.2010.  Subject to petitioner depositing half of the awarded amount with the State Commission within a period of four weeks, operation of the impugned order shall remain stayed till further orders.  Delay of 11 days, which we condone.
