On 21.10.2022, learned counsel for OPs No.1 & 2 had brought into notice of this Commission that OP-Insurance Company has already disbursed death claim of buffalo to the tune of Rs.77000/- vide cheque No.10476 dated 21.12.2020 and no amount of the complainant is remained due and also produced photocopy of the payment voucher vide which payment has been paid to the complainant.  So, complainant’s counsel was directed to secure presence of the complainant in person before the Commission on 12.11.2022  and thereafter on 17.11.2022. 

                        Today neither complainant nor his counsel is present. This act & conduct of complainant reveals that he has received the awarded amount, so he is not interested in pursuing the present complaint and opted not to come present before the Commission. It is 12.00 P.M.  Let, case file be again put up after lunch break.

                        Case file taken up but this time also neither complainant nor his representative appeared before the Commission.  Case called several times. It is 3.40 P.M. Waited sufficiently. Further wait seems not to be justified. Accordingly, we have no option except to dismiss the present complaint for want of prosecution.  Hence, the present complaint is hereby dismissed in default for want of prosecution. Certified copies of the order be sent to the parties concerned, as per rules. File after due compliance be consigned to the record room.
