The case record is posted today for hearing of the case. Neither the complainant nor his Advocate is present. The Advocate for O.Ps No.2 & 3 is present and files hazira and also files a memo to drop the case along with documents. On repeated calls, none respond on behalf of the complainant. Hence, hearing of the case could not be taken up.   

                                         In the present case, the O.Ps No.2 & 3 were appeared and filed their written version. O.P No.1 was set exparte. Further, the Advocate for O.Ps No.2 & 3 filed a memo supported by documents that the problem of the complainant was solved and there is no arrear dues pending against him. As it appears from the case record, the complainant did not turn up and slept over the matter since 17.07.2018  and no step is taken nor did his advocate take any step on his behalf, for which hearing of the case impaired and further the valuable time of this Commission is being wasted. Considering the above facts and circumstances of the case and the nature and conduct of the complainant, this Commission is of the view that the complaint of the complainant should be dismissed.                

                                         Accordingly, the complaint of the complainant is dismissed for non-prosecution of the case. The interim order, if any, passed against the Ops is treated to be infructuous.
