ORDER

This revision petition has been filed by the revision petitioner/Opposite Party, against the order dated 09.07.2019 passed by District Consumer Disputes Redressal Forum-I, UT, Chandigarh, vide which, Opposite Party was proceeded against exparte.

                        Service is complete.

                        Sh. Mandeep Singh, Advocate has put in appearance on behalf of the respondent by filing his Vakalatnama, which is taken on record. He has raised no objection to set aside the impugned order. The matter is still pending before District Forum-I, U.T., Chandigarh for 30.11.2019. However, bare perusal of impugned order transpires that notice was sent through registered post. However, it was not mentioned that whether it was sent alongwith acknowledgment due. Therefore, presumption arises that notice was sent though registered post without acknowledgment due. Apart from it, every party has right to represent and to be heard.  

                        Keeping in view the facts of the case, the revision petition is allowed. The impugned order is set aside. The revision petitioner will file reply before the Forum within a period of 15 days from today with advance copy to the Counsel opposite. The concerned Forum shall proceed further in accordance with law.

                        Parties are directed to appear before the Forum concerned on 30.11.2019.

                        Record be sent back to the Forum concerned alongwith certified copy of this order so as to reach there before the date fixed.

                        Certified copies of this order be given dasti to the parties/their Counsel free of charge.
