Final Order / Judgement

ORDER

            The complainant’s case is as follows: On 30/10/07 the complainant had approached the respondent for buying Mox 500 tablet.  The respondent sold the medicine as per bill No.87902.  After taking these medicines the complainant  suffered severe other diseases.  There after when checked the medicine given by the respondent it was seen that the respondent had given Foxi 500 instead of Mox 500.  Due to the intake of this medicine he lost the whole skin from the body, lost vision, nails and teeth decayed and whitening of hair like side effects occurred.  So he was admitted in the ICU of Jubilee Mission Medical College Hospital, Thrissur for 7 days and there after in the hospital ward for some days.  He purchased the medicines by showing the prescription of the doctor.  All these miseries was happened due to the mistake committed by the respondent.  The act of the respondent shows deficiency in service and unfair trade practice.  A lawyer notice was sent, but no remedy after that also.  Hence the complaint.

 

          2. The respondent is called absent and set exparte.

 

          3. To prove the case of the complainant he filed affidavit and produced Exhibits P1 to P5.

 

          4. According to the complainant he purchased the medicines by showing Exhibit P1 prescription.  After the intake of medicines issued by the respondent he developed other severe diseases.  So from the checking of medicines given by the respondent it was found that the respondent issued Foxi 500 instead of Mox 500.  It can be seen from Exhibit P2.  His condition became worse and as per Exhibit P3 he was admitted in the ICU of hospital for some days and treated further in the hospital ward also.  Al these mishappenings occurred due to the intake of the false medicine given by the respondent.

 

          5. There is no counter evidence.

 

          6. In the result the complaint is allowed and the respondent is directed to pay Rs.25,000/- (Rupees Twenty five thousand only) as compensation and Rs.500/- as costs within one month from the date of receipt of copy of this order.  If not the compensation amount will carry 12% per annum from the date of complaint.
