The order under challenge is dated 17.03.2016 by which the petitioner herein i.e. OP before the Ld. District Forum has been proceeded ex-parte.

        The aforesaid order reads as under:

        “AR of the complainant OP is not present last date proceed ex-parte against him. To come up for F.P. on 19.05.16, at this stage present come of OP and filed an application for attendance”.

                                                                                               

        After some arguments, respondent/complainant who is present in person states that he has no objection if the ex-parte proceedings against the appellant/OP are set aside, subject to payment of costs.

        In the interest of justice as well as for effective disposal of the case on merits as well as for the reasoning given, we accept this appeal and set aside the order dated 17.03.2016, subject to payment of costs of Rs. 3000/-.

        It is stated that the matter is listed before the Ld. District Forum tomorrow i.e. 19.05.2016.

         Let the parties appear before the Ld. District Forum on the aforesaid date.

         The petitioner/OP shall pay the costs to the respondent/complainant and thereafter the Ld. District Forum shall proceed further in the matter in accordance with law.

          A copy of this order be sent to the Ld. District Forum for necessary information.

        File be consigned to record room.
