None has appeared on behalf of the appellant inspite of several calls, whereas learned counsel Sh. Vivek Painuli for respondent has appeared.

Learned counsel for the respondent has stated that the delay condonation application was allowed on dated 28.11.2016 and the delay of 61 days in filing the appeal was condoned, subject to the payment of Rs. 2,000/- as costs, which shall be paid to the respondent, but in compliance of the above order dated 28.11.2016, no such costs was ever paid to the respondent. Hence, the condition was not fulfilled.

As per the office report, no such costs was ever deposited before the Commission, therefore, the delay cannot be deemed as condoned.

In such circumstances and in the absence of appellant as well as non-compliance of the order dated 28.11.2016, the case shall stand as dismissed. No order as to costs. 

A copy of the order be sent to the concerned District Commission for perusal and necessary information.

File be consigned to the record room alongwith the copy of the order. Original file be sent back to the Commission concerned.
