Order dated 24th December, 2012 passed by the Himachal Pradesh State Consumer Disputes Redressal Commission, Shimla in First Appeal No. 244 of 2012 is the subject matter of this revision petition by the Canara Bank. By the impugned order, the State Commission has dismissed the appeal of the petitioner in default on account of non-appearance of their counsel. Having heard learned counsel for the parties, we are of the view that in order to avoid further delay in the disposal of the petitioner appeal on merits involving a very small amount, it would be in the interest of justice if the impugned order is set aside by adequately compensating the respondent/complainant for the inconvenience caused to him on account of default on the part of the petitioner. Accordingly, we allow the revision petition; set aside the impugned order; and restore the aforesaid appeal to the file of the State Commission for disposal on merit, subject to the petitioner paying to the respondent/complainant cost of these proceedings, quantified at Rs.15000/-. The said amount shall be paid to the respondent/complainant before the State Commission. The parties/their counsel are directed to appear before the State Commission on 17th February, 2014 for further proceedings.
