  1. In brief facts of the present complaint are that the complainant is the registered consumer of K No. 41100135006 sanctioned for 1 KW for domestic purposes installed at House of complainant.  
  2. It is stated that complainant is using two three bulbs and two fans and paying regular bills and never misused electricity. It is further stated that on 13.09.2011 complainant went to the office of respondent at Bawana branch to deposit the bill dated 17.08.2011 and also made complaint of receiving excessive bill due to excessive reading and in the impression that meter is defective. The officials asked him to pay full bill of 11,130/-. Thereafter the complainant lodged complaint with consumer care supervisor having No. 2011922686. An official visited house of complainant and checked the meter and also taken photograph from his mobile phone and told meter is jumping and faulty. The official also told that he would give the report.
  3. It is stated that complainant never tempered with the meter or its seal or its position and in case of any defect complainant is not responsible. The complainant is using the electricity in a very small quantity and is a poor person. It is further stated that there is deficiency of service therefore complainant suffered mental agony and pain therefore entitled for Rs. 25,000/- as damages and correction of bill as per average of past compensation.  
  4. Notice was issued to OP who appeared and detailed Written Statement. In the WS OP has taken preliminary objections that present complaint is without any cause of action in fact complainant is defaulter / irregular in making payments of consumption bills since years last payment of bill was made on 15.03.2011 therefore cannot take advantage of his own wrongs therefore present complaint is liable to be dismissed.
  5. On merits all the allegations are denied. It is stated that due to passive approach in paying the current demand charges due to which arrears accumulated to the tune of Rs. 40,449/- along with LPSC of Rs. 21,882/-, current demand of Rs. 6,436/- and NTA Rs. 20,932/- due to stay. It is further stated that the accrual of said amount was due to the default in the payment of current demand charges and other electricity dues for which complainant is legally and contractually bound to pay.

It is stated that assessment was done on the ground meter jumped / abnormal reading and bill revised with effect from 24.06.2011 to 11.11.2011 on the basis of previous one year consumption resulting in credit JE of Rs. 19,189/- and same was reflected in the next bill dated 10.01.2012 having number 10060774378 therefore impugned demand of Rs. 20,340/- ceased to exist on the day of filing of the complaint. The summary, bill dated 10.01.2012 and details of amount refunded filed on record. The grievance of complainant was duly resolved therefore present complaint is liable to be dismissed.
  7. As per record complainant has not filed Rejoinder. However complainant filed evidence by way of affidavit. In the affidavit complainant reiterated the facts mentioned in the complaint and relied on consumption history shown in the bill dated 30.03.2012 Exb CW1/1, Copy of complaint Ex CW1/1, Bill dated 17.08.2011 EX CW 1/3, another bill Ex CW1/4 and notice Ex CW1/5, Copy of Reply Ex CW1/6 and postal receipts EX CW1/7, Copy of bill dated 10.01.2012 Ex CW1/8 and average consumption Ex CW1/9.
  8. OP also filed evidence by way of Affidavit of Sh. Ashish Bhatnagar Sr. Manager and reiterated contents of the written statement.
  9. OP filed evidence by way of Affidavit of Sh. O.P. Monga HOG (R & C) and relied upon copy of statement of account Ex. DW1/1.
  10. The complainant and OP both filed Written Arguments. 
  11. We have heard complainant in person and  Sh. Harish Purohit AR of OP and perused the record.
  12. The complainant admitted that he is the registered consumer of K No. 41100135006 sanctioned for 1 KW for domestic purposes. It is admitted by the OP that impugned bill of Rs. 20,340/- having No. 1003065555 raised. It is further admitted by OP that it was a case of meter jump / abnormal reading and same was revised and demand of Rs. 20,340/- waived. The statement of account further showed that the impugned bill stood waived off therefore grievance of complainant qua impugned   bill stands resolved. It is pertinent to mention here that during the course of proceedings it is apprised that since May 2012 till April 2023 again complainant didn’t pay electricity bills however this nonpayment issue is a separate cause of action and we cannot enlarge the scope of present complaint beyond the main relief.
  13. Therefore we do not find any deficiency of service. The impugned bill stands withdrawn therefore the grievance of complaint stands resolved. Accordingly complaint is dismissed. No order as to costs.  

 

  1. Copy of the order be given to the parties free of cost as per order dated 04.04.2022 of Hon’ble State Commission after receiving the application from the parties in the registry.
