The case pertains to misuse of electricity by the Residents of M-Block, Moti Bagh, New Delhi who have been issued a show-cause notice by the OPs for unauthorized use of electricity.  The OPs have invoked the provisions of Section 126(6) of  the Electricity Act, 2003 by issuing show-cause notice as to why misuse charges @ 50% of domestic tariff shall not be levied against  the complainants for extension of electric connection from one premises to another inter-alia.  Therefore, the case pertains to unauthorized use/theft  of electricity which is beyond the jurisdiction of this Forum in terms of judgment of the Apex Court in the case of U.P. Power Corporation Ltd. and Ors Vs Anis Ahmad arising out of SLP (C) No. 35906 of 2011 decided on 1.7.2013.

In view  of the settled  law, the complaint is dismissed with no order as to costs.

     Let a copy of this order be sent to the parties as per regulation 21 of the Consumer Protection Regulations.  Thereafter file be consigned to record room.
