The petitioner Rabiul Sk filed the instant case against Nazirpur Group Electricity, Station Manager, Nazirpur U/S 12 of the Consumer Protection Act, 1986.  The meter (No. 334002481) at the premises of the petitioner was moving very fast and as a result the unit consumption was showing abnormally high in the monthly bill.  But the petitioner actually did not consume such a high unit.  The petitioner prayed before the Forum for a direction upon the OP to change the meter and issue the bills afresh and claimed a compensation of Rs. two lakhs for his mental agony and pain.  The OP in his written version denied all the allegations and put stress on the maintainability of the case the alleged meter is not in the name of the petitioner and hence Rabinul Sk is not a consumer under the OP.  The consumer of the alleged meter is one Lakimuddin Sk who happens to be the father of Rabiul Sk.  So the petitioner has got no locus standi to file the instant case.  From the documents, pleadings of the petitioner and verbal submission of the parties the forum holds the same view with the OP that since the consumer of the meter is Lakimuddin Sk and not Rabiul Sk the case is not maintainable in its present form.

            Hence,

Ordered,

            That the case is disallowed and dismissed on the point of maintainability without any cost.

                        Let the copy of the order be supplied to the parties free of cost.
