FINAL ORDER
This is an Execution Application which arose out of CC/35/2012 for realization of Rs. 40,000/- plus interest as per final order passed on 06.12.2012 .
Ld. Lawyer for the D.hr. files hazira. Ld. Lawyer for the J.dr also files hazia.
Ld. Lawyer for the J.dr by filing a petition prays for recall of W/A as the J.dr has already paid his dues to the D.hr by depositing a D.D. No. 620174 dt. 8.4.16 .
It appears from the Order No. 34. dt. 23.05.16 that the D.hr. has received the D.D. No. 620174 dt. 8.4.16 for Rs. 21,600/- as full and final satisfaction.
It is also revealed from the said order that specific order has been given to the Commissioner, Asansol-Durgapur Police Commissionerate, G.T. Road, Kumarpur, P.O. Asansol, Dist. Burdwan for recalling the W/A. The said order was communicated to the Commissioner.
At this juncture, we have no other alternative but to dispose of the Execution Application.
Hence,
Ordered
that the Execution Application No. 5/2013 be and the same is thus disposed accordingly with full satisfaction.
Let a plain copy of this order be made available and be supplied free of cost, to each of the parties on contest in person, Ld. Advocate/Agent on record, by hand under proper acknowledgment / be sent forthwith under ordinary post to the concerned parties as per rules, for information and necessary action.
