This appeal has been preferred against the order dated 10.9.2015 of the District Consumer Forum, Jaipur 2^nd for enhancement of the compensation.

 

The contention of the appellant is that meagre amount of Rs.7000/- has been awarded to him. Hence, it should be increased.

 

The court below has mentioned that it has been brought to notice that wife of the appellant was operated for breast cancer on 26.8.2006. Thereafter she was advised for physiotherapy and exercise. It has also been medically proved that swelling in hand and body pain is natural consequences of breast cancer and operation for which physiotherapy was needed. Nothing has been brought on record that how the respondents were negligent in treating the appellant. Inspite of this the court below has sympathetically awarded compensation to the appellant alongwith reimbursement of medical expenses and Rs. 3000/- for cost of complaint. Total Rs.10,000/- has been awarded in the head of physical and

mental agony and cost of proceedings. No interference is needed.

 

Hence, no case is made for enhancement of compensation. The appeal is dismissed.
