Final Order / Judgement

The admission hearing was taken up when the Ld. Advocate of the complainant advanced arguments.

From the complaint petition read with annexure, morefully the terms and conditions of the membership agreement dated 08.08.2022 (page 13 to 24) between the petitioner and the tour & travel company,it is evident that no where there isany element of cogent reason available justifying the crux of the complaint, which centres around the allegation by the complainant against the OP that the desired level of accommodation were not provided at their opted tourist locations. There is no breach of terms and conditions.

No cancellation clause is also available in the said agreement dated 08.08.2022 which allows the petitioner to terminate the contract for getting full refund of the paid amount, beyond cool off period.

The complaint is devoid of merit and the complainant has failed to make out a case.

Hence it is ordered that the complaint petition be and the same is dismissed as being not admitted.

Let a plain copy be given to the parties free of cost as per CPR.
