Heard on the point of admission of complaint. Briefly. allegations of the complainant are that he agreed to purchase one plot measuring 1000 Sq. yards from opposite parties vide agreement dated 30.4.2012 and paid first installment of Rs.31,250/- vide receipt No.64239 dated 30.4.2012 and booking letter dated 9.5.2012 was issued to him. It is alleged that opposite parties demanded second installment from the complainant, but the complainant is not shown the site of the plot nor any plot number is allotted to him. The complainant has prayed for refund of the earnest money of Rs.31,250/- alongwith interest and compensation.

We have heard learned counsel for complainant on the point of admission of complaint.

It is relevant to mention that the plot is stated to be situated at Talwara and office of opposite parties is stated to be at Abohar. However, one branch of opposite parties is situated at Bathinda. Copy of agreement reveals that the complainant entered into an agreement through branch Mukatsar. There is no document on file to prove that any transaction is done within the jurisdiction of this Forum i.e. District Bathinda. The cause-of-action does not arise at Bathinda only for the reason that one of the branch of opposite parties is situated at Bathinda, when no transaction has taken place in Bathinda. Therefore, this Forum has no territorial jurisdiction to try and entertain the present complaint.

Accordingly, complaint in original alongwith copy of this order is ordered to be returned to the complainant through his counsel against the valid receipt. Papers of this Forum be consigned to the record room.
