  1.  The complaint pertains to deficiency on part of OP in providing visa services.

 

  1. Brief facts as stated in complaint are:  The complainant engaged OP for preparation and submission of his immigration case for Canadian permanent resident visas for Canada skilled worker immigration process. The complainant paid Rs.50,000/- .  His original certificate regarding his education was submitted with OP.  It is alleged that the client coordinator, Mr. Harneet Singh, working for OP assured and guaranteed verbally and through Whatsapp to get a permanent residential status of the complainant. The complainant was informed by OP that he possess requisite experience and educational qualification and he just needs to obtain  credential evaluation report and 6 bands in IELTS GT exam.  The complainant paid Rs.16,000/- and Rs.12,300/- respectively  for the said  report and examination

 

  1. It is alleged that quality immigration assistance and solution were not provided by the consultant before and after the enrolment for the program. The complainant further alleges that he was promised full refund if the service was not satisfactory.  However, no refund was made.

 

  1. The complainant prays for refund of the full fee amount of Rs.50,000/-, 14,000/- of credential evaluation report and fee of Rs,12,300/- of IELTS Exam, Rs.50,000/- towards the physical strain and mental agony and Rs.50,000/- towards cost of petition.

 

  1. Notice was issued to OP and duly served but none appeared.  OP proceeded ex-parte vide order dated 24.02.2023. 

 

  1. Complainant has filed evidence by way of affidavit and exhibited the following documents:-
  1. Copy of cheque of Rs.50,000/-  is exhibited as CW-1.
  2. Copy of valid passport is exhibited as CW-2.
  3. Copy of Whatsapp chat proof is exhibited as CW-3.
  4. Copy of Credential Evaluation Report Certificate is exhibited as CW-4.
  5. Copy of IELTS exam payment receipt is exhibited as CW-5.
  6. Copy of legal notice is exhibited as CW-6.

 

  1. The Commission has considered the material and documents on record.  The complainant has paid Rs.50,000/- to OP vide receipt dated 09.10.2018. The complainant has also paid Rs.12,300/- towards IELTS examination vide receipt dated 25.02.2019. The complainant has also placed educational credential assessment by WES, Canada, dated 20.12.2018.

 

  1. The Whatsapp chat with Mr. Harneet on +91 8448033558 has been annexed. In the said chat, the said Mr. Harneet promises 100% PR (Permanent Residency).  The complainant has sent all his educational certificates as recorded in the said whatsapp chat.

 

  1. OP has neither appeared nor rebutted the allegations regarding deficient service of the complainant. The complainant had sent the certificates for educational qualification and was also promised 100% permanent residency. Hence, in the interest of justice, it would be suffice for the OP to refund Rs.50,000/- received from the complainant.
