3.      National Seeds Corporation Limited (NSC) (A Govt. of India Undertaking) through its authorized Dealer M/s Durga Sales Agency Loharu Road Bhiwani.

 

4.      National Seeds Corporation Limited (NSC) ( A Govt. of India Undertaking) through M/s Jagdish Store Tilak Bazzar Hisar.

O R D E R

The instant appeal has been filed by Balbir Singh–complainant against the order dated July 12^th, 2016 passed by District Consumer Disputes Redressal Forum, Bhiwani (for short ‘District Forum’) whereby, the complaint was dismissed in default.

2.      Learned counsel for the appellant has urged that on July 12^th, 2016, the complainant was present before the District Forum and when the case was called, the complainant went to contact his counsel. When they came to the District Forum, the complaint was dismissed in default. 

3.      Be that as it may, without delving deeper, this Commission deems it appropriate to restore the complaint.  The appeal is accepted and the impugned order is set-aside. The complaint is restored to the board of District Forum for adjudication.

4.      The parties are directed to appear before the District Forum on November 23^rd, 2016.

5.      Copy of this order be sent to the District Forum.
