Complaint u/s 12 of the Consumer Protection Act, 1986.

 Present:   None for complainant.

 

                 Today the complaint was fixed for issuance of notice to OP No.2 on filing of correct address by the complainant. Correct address not filed by the complainant.  On perusal of the file, it reveals that on 14.01.2020, on the application of complainant, Op No.2 was impleaded in the array of opposite parties and complaint was adjourned for 26.03.2020 for filing the correct address of Op No.2 but till date, correct address has not been filed by the complainant. The complainant has already availed several opportunities for supplying the correct address of Op but he failed to supply the same.  Neither today nor on the previous dates i.e. 25.08.2021 and 09.11.2021, none has appeared on behalf of complainant.  It appeas that the complainant is not interested to pursue his complaint further.  Hence, the present complaint is hereby dismissed for want of prosecution as-well-as non-filing of correct address by the complainant.  However, the complainant is at liberty to file fresh complaint on the same cause of action in the court of competent jurisdiction, if so desired.  In view of the law laid down by Hon’ble Supreme Court in Laxmi Engineering Works Vs. PSG Industries Institute (1995) 3 SCC 583 the complainant would be at liberty to get the benefit of provisions of Section 14 of the Limitation Act, to exclude the period spent in prosecuting the present complaint before this commission while computing the period of limitation prescribed for filing such complaint.  The original documents annexed with the complaint, if any, be returned to the complainant by placing on record photocopies thereof. The parties concerned be communicated of the order accordingly and the file be consigned to the record room after due compliance.
