       Counsel for  DH  alongwith DH in person present. Counsel for JD
present. Counsel for JD has filed a proof of Rs. 3,73,910/- paid to
the DH. DH states that an amount of Rs. 11,57,663/- is due from the JD
which the JD denies stating that as per the direction of this forum
dated 09.01.2014 the claim was to be finalized by the JD and they have
finalized the claim at Rs. 3,73,910/-  on the basis of surveyor report
which is placed on record, Rs. 25,000/- as compensation amount and Rs.
5,000/- litigation charges have already been paid to the DH
separately. The amount of Rs.3,73,910/-  has been received by DH
without prejudice to his right. Accordingly, he may take an
appropriate action against JD.

As order dated 09.01.2014 passed by this forum in C.C. No.  16/2012
has been complied with though  DH is  not satisfied with the amount
awarded in the claim. As amount of the claim is not specified by the
forum in above order ,therefore,  DH is at liberty to take appropriate
action against it.  Accordingly this execution is dismissed. Copy of
this order be made available to the parties free of cost as per law.
File be consigned to record room.
