Gaurav Kumar Vs. National Insurance Company

File taken up today on an application moved by learned counsel for the OP no. 1 and 2. Parties to this complaint have entered into a compromise. Learned counsel for OP no. 1 and 2 has made as statement that he being authorized representative of M/s National Insurance Company, and ready to settle the present matter for total amount of Rs. 24,165/- against claim/Motorcycle no. HR-87-D-2379 in full and final settlement towards the claim of the complainant, subject to submit Form 29-30, cancellation of RC, affidavit and indemnity bond as well as subrogation letter by the complainant to the insurance company. A period of 45 days may be given to make payment of the said amount by the insurance company. Statement of the counsel for the complainant has also been recorded.
Keeping in view of the statements made by the parties, respondent is directed to pay Rs.24,165/- to the complainant towards full and final settlement of claim within 45 days, subject to submit Form 29-30, cancellation of RC, affidavit and indemnity bond as well as subrogation letter to the insurance company, failing which opposite party no. 1 and 2 will be liable to pay interest @ 7% p.a. on the aforesaid amount from the date of filing of this complaint till realization of the said amount. Hence, the complaint is disposed off accordingly. File be consigned to the record room.
