  Complainant is absent.  None present on his behalf.

Attendance on behalf of o.p has been filed.

The learned lawyer for o.ps submits to dismiss the Misc. petition because the same is not maintainable and this forum has not jurisdiction  to entertain this petition.

Perused the record. This Misc. petition  has been filed against  order dated 23-11-2015 with prayer to restore the original   complaint petition  No.- 87/2011. It has been mentioned in the petition that due to latches of the advocate of the complainant,  the case was dismissed.

In the case of Rajeev Hitendra Pathak  and other V/s Achut Kashinath  Harkar and another civil appeal No. 4307/2007 Hon’ble Supreme Court has been pleased  to observe that this forum has got no power to review or restore/recall  its own order.

In view of the observation  of the Hon’ble Supreme Court this forum is not authorized to restore/recall his previous order. In the circumstances, this Misc. petition is dismissed
