Case has been called several times since morning and ultimately at 4.00 P.M, but none appeared on behalf of the DH. On the last date of hearing i.e. 22.3.2016 none appeared on behalf of the DH. As per report, Counsel for the DH has already received a Cheque for Rs.2,08,919/- in miscellaneous application No.01/2016 and his statement in this regard has been recorded in the said miscellaneous application. This shows that complainant/DH is no more interested in further prosecuting his present execution application. Therefore, the present execution application is hereby dismissed-in-default for want of prosecution. File be consigned to the record room.

Copy of this order be placed on miscellaneous application No.01/2016 connected file and papers of that file be also consigned to the record room.
