Today is fixed for passing necessary order on verification of the bankers cheque submitted on 02.07.2014. The order No.5 dated 23.07.2014 shows that the DHR by filing separate three petitions prayed to put up the case record on such date and to pass necessary order to hand over the cheque as mention in order No.3 dated 02.07.2014. Accordingly the case record was put up on 23.07.2014 and allowing the prayer of the decree holder the bankers cheque for Rs.1,70,616/- was handed over to the DHR.

On 23.07.2014 the DHR filed another petition praying to dispose of the case on full satisfaction. Said petition was kept with the record for disposal on the date fixed.

Accordingly the petition dated 23.07.2014 with the prayer for disposal of the case is taken up for hearing.

On call both the parties are present. Heard both the sides. The Ld. Advocate for the DHR submits that the JDR has paid entire decreetal amount of Rs.1,70,616/- by bankers cheque and the DHR has received the same on proper receipt. The orders passed in this case clearly support the submission of the Ld. Advocate for the DHR. The Ld. Advocate for the DHR has submitted that the DHR will not make any further claim against the JDR on the basis of the judgment passed in CC case No.52/2013 on 25.03.2014 and he is satisfied with the payment as made by the JDR.

In the above premises we do not find to continue the proceedings of this case further.

Hence it is

                                    ordered        

that the  EA case No. 13/2014 is disposed of on full satisfaction.
