                        Sh.Rajesh Verma, Advocate for OP No.1.

                        None for OP No.2.

                                                            ORDER

1.                     This case has been taken up today in the Lok Adalat. Counsel for OP No.1 has made offer as per the statement given below:

“Statement of Sh.Rajesh Verma, Advocate for OP No.1 Insurnace Company.

I have no objection if the amount deposited with this Forum in the above noted case, is released to the complainant as per the orders passed therein, to satisfy the award. An amount of Rs.25,000/- deposited by the OP No.1 at the time of filing the Appeal No.140 of 2010 is lying deposited with the Hon’ble State Commission. Rest of the payment has also been paid to the complainant. The order dated 26.2.2010 passed by this Forum stands complied with. However, due if any, is subject to calculations” 

2.                     Counsel for the complainant has accepted the offer as per the following statement:-

“Statement of Sh.Ajay Mehra, Advocate for Complainant.

I have heard the statement made by Sh.Rajesh Verma, Advocate for OP No.1 and accepted it as correct subject to calculation. The amount lying deposited with this Forum in the above noted case may kindly be released to the complainant. I have already filed misc. application in the Hon’ble State Commission for the withdrawal of Rs.25,000/-”

3.                     The respective parties shall remain bound by their statements.

4.                     The sum of Rs.2,32,933/- already deposited by OP No.1 with this Forum be paid to the complainant. The office is directed to issue a cheque for the like amount in favour of the complainant. The appeal No.140 of 2010 filed by OP No.1 has already been dismissed by the Hon’ble State Commission on 3.11.2010. For the remaining amount of Rs.25,000/-, counsel for the complainant states that he has already filed misc. application in the Hon’ble State Commission for its withdrawal. In view of the above, the execution application filed by the complainant stands disposed of as fully satisfied.

5.                     Copies of this order free of cost be supplied to the parties. The file be consigned.
