          None is present for applicant. Adv. Mr J Vora for non-applicant No.1 and Adv.Smt Paunikar for non-applicant No.2 are present.

         

This is an application for restoration of the Revision Petition No. RP/04/24 which is dismissed for default by an order dtd.04.09.2004 by this Commission.

         

Applicant wants to recall the said order. In view of the provision of Sec.22-A the power to set aside the ex-parte order, is only given to the National Commission. There is no any empowerment to the State Commission to recall its ex-parte order.

         

Under the circumstance, this Misc. Application is devoid of any substance. Holding accordingly, we pass the following order:-

 

ORDER

 

1.      Misc. Application stands dismissed.

2.      In the given circumstances no order as to cost.       

3.      Inform the parties accordingly.
