ORDER

 

Counsel for the OP has filed application u/s 40 CP Act 2019 seeking review of Order dated 04/01/2023 wherein Ops were proceeded ex-parte. Argument heard on review application. During the arguments as well as in the present application since the applicant/OP did not mention any sufficient cause for non-appearance on that date. Even otherwise, in view of the SCDRC judgment “ Nipun Sharma Vs G.L.C. Members Co-operative decided on 21/10/2021 in FA no. 306 of 2021 the National Commission categorically stated that this Commission has no jurisdiction to restore the matter. Hence the present review application is dismissed. File be consigned to record room.
