| Final Order / Judgement | Order No. 4 Dated: 22.05.2024 Today is fixed for admission hearing. Ld. Advocate for the complainant is present. On bare perusal of the complaint petition it appears that the complainant has filed the instant case against 7 OPs out of which the OP-1 carries their business within the jurisdiction of this Commission and the other OPs carry their business outside the jurisdiction of this Commission. Besides that the complainant resides at Flat 4A, 9/2B Orient Row, Park Circus, P.S.-Topsia, Kolkata-700017 which is beyond the jurisdiction of this Commission. It also appears that the instant Consumer Complaint has been filed by the complainant on 26.04.2024. No steps is taken for the complainant as to the territorial jurisdiction of this Commission in spite of several opportunities. In view of the above discussion, we are not inclined to admit the Consumer Complaint in its present form and the same is rejected due to lack of territorial jurisdiction. However, the complainant is at liberty to file afresh in appropriate Commission or court of law on the same cause of action if so advised, and if not, otherwise barred by law. | |
