ORDER

                                    Bharat Cereals Pvt. Ltd Versus NIC

 

Present:     None for complainant.

 

Today the case was fixed for consideration on admissibility of complaint. Neither today nor on the previous date of hearing none has appeared on behalf of complainant.

                   A careful perusal of the title of the complaint reveals that the complaint has been filed by Bharat Cerals Pvt. Ltd Pakhana-Nadana Road Village Pakhana, P.O. Taraori, Tehsil Nilokheri, District Karnal, through its Authorised Signatory Shri Nipun Bansal and Shri Nipun Bansal is Chartered Accountant in the company (complainant) who was allegedly authorized by the Board of Directors to file the present complaint.                   

                   As per Section 2 (5) of the Consumer Protection Act, 2019, “complainant” means-

1. A consumer; or
2. Any voluntary consumer association registered under any law for the time being in force;or
3. The Central Government or any State Government; or
4. The Central Authority; or
5. One or more consumers, where there are numerous consumers having the same interest; or
6. In case of death of a consumer, his legal heir or legal representative; or
7. In case of a consumer being a minor, his parent or legal guardian;

 

                   As per Section 2 (5) of the Consumer Protection Act, 2019, which was reproduced above, Mr.Nipun Bansal, who has filed the present complaint does not fall in the definition of consumer, hence, the present complaint is hereby dismissed. However, complaint can be filed afresh by competent person/consumer. File be consigned to record room, after due compliance.
