ORDER

Dated the 22^nd February, 2011

                        This is an application filed by the complainant for the execution of the order dated 9.11.2010 passed by the Hon’ble National Commission in RP No.1342 of 2010. On behalf of OP, Sh.Nirmal Singh Jagdeva, Advocate, has appeared and stated that the OP Insurance Company deposited Rs.25,000/- with the Hon’ble State Commission at the time of filing the appeal No.506 of 2009. He further stated that the OP deposited a total sum of Rs.7,57,612/- (Rs.3,55,000/- + Rs.29,527/- + Rs.3,73,085/-) with this Forum and out of the said amount, a sum of Rs.5,92,662/- (Rs.5,82,662/- + Rs.10,000/- as costs of the proceedings throughout)  be released to the complainant and the amount of Rs.1,89,950/- (Rs.1,64,950/- deposited with this Forum and Rs.25,000/- deposited with the Hon’ble State Commission) be released to the OP Insurance Company. The complainant has agreed with the submissions of counsel for the OP. Statement of both the parties has been recorded separately.

                        The office has reported that total amount of Rs.7,57,612/- is deposited in the A/c of DF-I. Accordingly, out of Rs.7,57,612/-, the sum of Rs.5,92,662/- be paid to the complainant and Rs.1,64,950/- be paid to the OP Insurnace Company. The office is directed to issue a cheque accordingly in favour of the complainant and OP-National Insurance Co. Ltd. For the remaining amount of Rs.25,000/-, a request be sent to the Secretary, State Commission, U.T. Chandigarh, to release the said amount in favour of OP National Insurance Co. Ltd. and deposit the cheque in this Forum for onward transmission to them. The execution application of the complainant as well as misc.application No.8 of 2011 filed by OP Insurance Co. stands disposed of accordingly.

                        Copies of this order free of cost be supplied to the parties.  The file be consigned.
