ORDER

     Office report seen. The present miscellaneous application has been moved by applicant/complainant for directing the OP No.5 to release/deliver his car. The main consumer complaint file has been received. It has been mentioned in the application that the applicant/complainant handed over his car Maruti Suzuki Ciaz (CH01 BQ 4989) to OP No.5 for repairs. The OP No.5 raised a bill amounting to Rs.26,067/- for repair work, but the insurer and surveyor wrongfully made an assessment of Rs.18,421/- only against the total bill of Rs.26,067/-. It is argued by counsel for complainant that only Rs.7646/- is left to be paid to OP No.5 for which they are not releasing the car and they are asking parking charges @ Rs.350/- per day w.e.f. 26.10.2021.

     We direct that on depositing Rs.7646/- by the complainant with the OP No.5, the OP No.5 shall immediately release/deliver the car in question to the complainant and the matter of remaining amount will be decided in the consumer complaint which is listed on 09.03.2022. The aforesaid payment made by complainant shall be subject to the decision of main consumer complaint. The present miscellaneous applications stands disposed of accordingly. It be tagged with the main consumer complaint.

     Certified copies of this order be sent to the parties free of cost for compliance.
