Complainant is absent without any step. O.P. is present through his/their advocate. Case was posted today for passing necessary order. On perusal of case record it is seen that this case was filed by the complainant on 03/03/2021 through his appointed advocate. Ld. Advocate for the complainant took steps of notice on the O.P. immediately on 04/03/2021 which were properly served and both the opposite parties contested the case by filing their W/S on 20.04.2021, the first date fixed for their W/S. Thereafter, except 14/09/2021, the complainant is remaining absent before the Commission till date without any step and the case is pending for evidence of complainant for more than two and half years since 20.04.2021. Observing the act and attitude of the complainant this Commission has no reason to believe that the complainant is interested in proceeding the case any further. Under the circumstances the Commission deems it fit and proper to dismiss the case for default of complainant. It is also observed that the opposite parties are appearing on each and every dates fixed for the case.
